Killing people by duty of other people is termed as kartabya jyan. Knowingly or unknowingly no one is allowed to kill any other person. The life once gone can’t be returned again. The constitution of Nepal guarantees the right to live with dignity to every citizen. Killing is a type of act which is recognized as crime not just by the law but also by the society. It is a very serious act that harms or plays a role to weaker the social institutions. In legal term, murder means the killing by a sane person, with intent, malice afore thought and with no legal excuse or authority.   

At the time when this case happened, this sort of unlawful act were regulated by Muluki Ain 2020, chapter related to Human body but this provision has been replaced by Muluki Criminal Code, 2074 chapter 12. Even the law is changed the punishment for this type of case is the same, the punishment is life imprisonment except in some situations like when the act has happened unknowingly which are mentioned in the act.
