The idea that absolute power corrupts absolutely and thus people should be ruled by the word of law instead of whims of an individual or discretions of a selected few has been there in popular realm since the time of Aristotle, however in modern legal literature, the one who popularized this conception by the use of word, rule of law, that is so fluently used in political and legal discourse today, was AV Dicey. As the question demands, in this answer I will attempt to analyze what AV Dicey's conceptualization of this principle was, its short comings and how far the conditions in UK today abide by his ideals. AV Dicey described rule of law by three core principles of his that were, that no man should be punished except for the breach of law, this meaning that only a violation of law should result in punishment, as dicey further noted discretion should not result in legal sanction for there to be rule of law. Second that no man should be above the law and everyone should be equal in front of the law. Third that common law resulted in constitutional principles like freedom and rights, so courts are protector of liberty. The first principle that no man should be subject to arbitrary power or whims in UK gained gradual acceptance as it evolved from an absolute monarchy to a constitutional monarchy. In Magna Carta the King accepted this principle to be subjected to law. Subsequent parliament through numerous statutes tried to further strengthen this principle and today it is nearly an established fundamental of UK constitution that no man can be punished without a violation of law. The court decision in Entick v Carrington, established this principle by stating that no interference with rights of an individual can be done without expressed legal sanction allowing it. So by the time Dicey was putting forth this proposition, it was by in large a reality on ground in the UK. However, this does not avail that discretionary powers had ended by then. The government still exercised certain discretionary powers in case of an emergency, Jennings in his criticism of this limb of Dicey's argument states the numerous discretionary powers enjoyed by the police which negate the argument that in presence of discretions rule of law cannot exist and he argues that such discretions are essential to any modern executive. However, on deeper analysis of Dicey's writing we find out that by discretion he meant the executive in the ancient day ruling by whims. That is certainly not the case today in UK, even though discretionary powers still exist as they do in every country but they are sanctioned by the law and thus not a violation of the word of law. Further to add to this the principle that no one should be punished unheard, has also been upheld and now it is a convention right protected by the ECTHR and HRA, so based upon this we can assume that UK's legal system adequately confirms to dicey's first principle of the rule of law. The second principle that all men should be equal to law is key to the people's perception of justice not only being done but seen to being done and judicial system being fair because as Bingham points out without it, the trust of masses will be lost and they will move toward taking law in their own hands. Dicey's assertion that all men whether they be rich or poor, weak or powerful and most importantly part of the executive or the common masses should be held equal is fundamental to Rule of law even today. It defines the very principle approach of law in any democracy. UK has largely abided by this principle; the government ministers have been subject to the law; the most recent example was the home secretary being held in contempt of court in the case of M v Home Office. Further numerous statute including the CRA have enshrined this principle as an absolute of UK's constitution that no man is above the law. However, in UK there are offices that enjoy constitutional immunity. Dicey himself stated that the rule does not apply to the Queen because the Queen could do no wrong. Academics argue that this poses considerable qualification to what Dicey wants to assert as an absolute. When some men enjoyimmunity they can certainly not all be equal in front of the law. This is why Bingham qualification that all men are equal before the law until the circumstances require differentiation is a better description of how things operate in the UK. However, what dicey was trying in his time to state by his assertion that Queen could do no wrong, was that certain office for the well-functioning of the system require exception, this is not to suggest they hold this immunity as a person, if queen is impeached tomorrow she will surely be subject to law as all individual but that it is the office that enjoy this immunity. This is same in most modern democracies where Head of Government and Head of state (US President) enjoy certain immunities to ensure a smooth functioning of their office, so UK is not different in anyway in this regard. Further since parliament being supreme can in special circumstances where a gross breach of conduct or commission of a crime took place can possibly undo this immunity this in essence mean that UK does ascribe to this principle. It is just that stating it as absolute won't be right description. The third principle that the court are the protector of Human Liberties is true but to certain major exceptions. It is true that time to time availing the common law, courts have recognized new rights (R v R Marital Rape) but how far they can fulfill this role in vacuum is open to considerable limitations.
